How to become a real estate agent in NSW?

In NSW, if you wish to start a career in real estate, you will need to start as a registered "Associate Agent", although the steps are a little more complicated, you will be an expeLicenserienced real estate agent with a lot of experience.


  1. "Associate Agent" license

Licence features:


This is an entry-level position with limited functions that allows you to gain the experience and knowledge required to become a licensed agent in the real estate and property industry. You can apply if you are at least 16 years old.


Validity of registration certificate: 4 years (non-renewable).


Assistant agents must be employed by the licensee and supervised by a competent licensee holding a "Level 1 license" for the same category of work being performed.


Scope of work of the license:


Assistant agents can generally carry out any function n related to their type of certificate. However, as an assistant agent, you can't:


  • Enter into contracts for the sale of land;

  • Enter into agency agreements including sales agreements and property management (except for agency agreements involving the sale or purchase of livestock only);

  • Enter into concession agreements;

  • Act as an agent for the purchase, sale, exchange, lease, transfer, or other disposals of rural land or livestock, whether or not involving an auction;

  • Stamp the seal of the owner company (if you are an assistant agent for strata management) or authorise the withdrawal of funds from a trust account.

Information required to apply for a certificate of registration:


  • Personal and business details;

  • Two forms of identification, such as an Australian driver's licence or passport;

  • Proof of eligibility from a Registered Training Organisation(RTO);

  • Details of your previous licence or certificate of registration (if applicable);

  • Employment details (if applicable);

  • Payment of the certificate fee.


Next step:


Before you can apply for a level 1 licence, you need to have had a level 2 licence for 2 years. This helps develop your skills and experience and prepares you to undertake the additional function of a Level 1 agent.


3. "Level 1 Licensed Real Estate Agent" Licence


Licence feature:


  • You have held an unrestricted Level 2 real estate agent's licence for at least 2 years;

  • You have completed a Diploma in Property (Agency Management CPP51119), a Diploma in Property Services (Agency Management CPP50307) or a Diploma in Property (Agency Management CPP51122);

  • Completion of the appropriate work experience requirements for the following Level 1 agents within 2 years.


Scope of work for the licence:


A Class 1 licence allows you to do everything within the scope of work of the above 2 types of licence in the real estate industry and to act as a licensee(LIC);

Working independently as a sole proprietorship, which means you can own your own real estate company;

If you are a LIC, opening and authorising trust account transactions for the business;

Only a Class 1 agent nominated as a competent licensee of the business(LIC) can authorise withdrawals from the institution's trust account.


The information required to apply is the same as for a Class 2 licence.
